FledgeNow Privacy Policy
Eagletpip LLC ("Eagletpip," "we," "us," or "our") operates FledgeNow (the "Service"). This Privacy Policy explains what information we collect, how we use it, who we share it with, and the choices and rights available to you.
Our core commitment: we do not sell location data, trip data, or any personal information about you or other members of your Nest to third parties, ever. Information you share through the Service is visible only to the members of your Nest — never to the public, never to other FledgeNow users outside your Nest, and never to advertisers or data brokers. This is a foundational commitment of our product, not just a policy statement.
FledgeNow is currently offered free of charge; we do not currently collect payment information from users. If we introduce paid features in the future, this Policy will be updated accordingly.
1. Information We Collect
1.1 Information You Provide
- Name, email address, and phone number used for account registration and login (we verify your phone number with a one-time passcode sent by SMS).
- Information about members you invite to your Nest (name and phone number for account linking). When you invite someone using your device's contact picker, your device returns only the single contact you select — we do not access or upload your full address book.
- A profile photo, if you choose to add one.
- Sharing/notification configuration settings selected for each Nest member's device.
1.2 Information Collected Automatically from Nest Members' Devices
- Precise location (GPS): collected while the app is in use and in the background, and used to (a) detect trip start/end, (b) display each member's most-recent location to other members of their Nest on a map, and (c) include the sender's location and an approximate street address (via reverse geocoding) in an SOS. Your location is also refreshed and shared with your Nest when you send or receive an SOS or Emergency Alert. We store each member's most-recent location point per member — we do not build or store a continuous location history or movement trail.
- Motion and activity data: from the device's motion sensors, used to detect the start and end of trips.
- Trip events: automated detection of trip start and trip end.
- Battery status: device battery percentage, used to generate low-battery alerts.
- Permission status: whether Location, Motion & Fitness, Notifications, and Critical Alerts permissions are enabled, restricted, or revoked on a member's device.
- Messages and alerts you send within your Nest: the content of SOS and Emergency messages you send, and any acknowledgement replies, so they can be delivered to and displayed for the intended Nest recipients.
- Device and technical information: device type, operating system version, app version, and push notification tokens necessary to deliver alerts (including SOS and Emergency Alerts).
1.3 Information We Do Not Collect
- We do not build or store a continuous location history or movement trail — only each member's most-recent location point and discrete trip start/end events.
- We do not access your device's photo library (other than the single profile photo you choose to upload), your SMS/iMessage messages, your call logs, your browsing history, or the content of other apps.
- We do not collect screen contents, keystrokes, or general device app-usage analytics beyond what is described in this Policy.
2. How We Use Information
We use the information described above to:
- Generate and deliver trip start/end, battery, and permission-change notifications to the Nest member(s) designated to receive them, based on the Nest Admin's sharing configuration;
- Display each member's most-recent location to other members of their Nest on a map;
- Deliver SOS broadcasts (including the sender's location and approximate street address) and one-to-one Emergency Alerts between Nest members;
- Operate, maintain, and improve the Service, including improving the accuracy of automated trip detection;
- Provide customer support;
- Comply with legal obligations.
3. Our Configurable Sharing Model
FledgeNow does not automatically share every member's data with every other member. The Nest Admin can turn a device's outbound passive automatic notifications (trip start/end, battery status, permission-change alerts) on or off per device, as a whole — this is not a setting for individual message types. Turning them off stops that device from broadcasting its own passive events to the Nest; the device still receives other members' notifications.
SOS and Emergency Alerts are separate from this setting. Turning off passive automatic notifications for a device does not disable that device's ability to send or receive an SOS or an Emergency Alert.
Protection for Minor Members. Regardless of the sharing configuration in place, any Minor Member (age 13–17) connected to a Nest must be informed of what information about their device is being shared and with whom, per Section 2.3 of our Terms & Conditions. Configuring the Service to conceal its operation from a Minor Member is not permitted.
4. How We Share Information
We share information only in the following limited circumstances:
- Service providers who perform services on our behalf, restricted by contract to using data only to provide those services to us:
- Cloud hosting and database — Heroku (a Salesforce company), including Heroku Postgres, located in the United States;
- File storage — Amazon Web Services (AWS) S3, used to store profile photos;
- Push notification delivery — Apple Push Notification service (APNs);
- SMS one-time passcodes — Twilio, which processes your phone number to deliver login verification messages.
- Navigation (at your request): when you tap to navigate to an SOS location, your device passes the destination coordinates to your chosen maps application (for example, Apple Maps or Google Maps). This happens only when you initiate it.
- Legal requirements: if required to do so by law, subpoena, or other legal process, or to protect the safety of any person.
- Business transfers: in connection with a merger, acquisition, or sale of assets, subject to this Policy's continued protections or notice of any material change.
We do not sell personal information or location/trip data, and we do not share it with data brokers, advertisers, or marketing partners.
5. Data Retention
We keep as little as possible, for as short a time as possible:
- Location: we store only each member's single most-recent location point, overwritten in place as it updates. We do not keep a location history or movement trail.
- Trip history: trip start/end records are kept locally on your device and are not retained on our servers. Trip-event notifications pass through our servers only transiently in order to be delivered, and are not stored as a trip history.
- Messages and alerts (SOS and Emergency message content and acknowledgements): retained to support in-app message history and automatically deleted no later than 90 days after they are sent.
- Profile photos: retained while your account is active; deleted when you remove the photo or delete your account.
- Account information: retained while your account is active, plus a limited period thereafter only as required for legal, tax, or dispute-resolution purposes.
Deletion. When you delete your account, or when a Nest is deleted, all personal information associated with it — including the most-recent location point, messages, and profile photo — is deleted immediately, except where we are required to retain limited information to comply with a legal obligation.
6. Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect your information, including encryption in transit. No method of transmission or storage is 100% secure, and we cannot guarantee absolute security.
7. Children's Privacy and Teen Data
7.1 The Service is intended for use by a Nest Admin who is 18 or older, in connection with Minor Members aged 13–17. The Service is not directed at, and we do not knowingly collect personal information from, children under the age of 13. If we learn that we have collected information from a child under 13, we will promptly delete it and disable the associated profile.
7.2 We apply heightened care to Minor Member data: it is used solely to generate the notifications and features described in Section 2, is never sold, and is not used for advertising or profiling purposes.
8. Your Rights and Choices
Depending on your location, you may have rights to access, correct, delete, or receive a copy of your personal information, and to opt out of certain processing. You can also change or revoke Location, Motion, Notification, and Critical Alerts permissions at any time in your device settings, which will limit or disable the related features. 8.1 U.S. State Privacy Rights
Residents of certain U.S. states (including California, Colorado, Virginia, and others with comprehensive privacy laws) may have additional rights, including the right to know, delete, correct, and opt out of the sale or sharing of personal information, and the right to non-discrimination for exercising these rights. As noted above, we do not sell personal information.
8.2 Availability — United States Only
The Service is currently offered only in the United States. We do not currently offer the Service in Canada or other countries.
8.3 Where Your Data Is Stored
Personal information is stored and processed on servers located in the United States (via Heroku and Amazon Web Services).
8.4 Future International Expansion
The Service is not currently offered outside the United States. If we expand to Canada or other countries in the future, we will update this Policy — before such expansion takes effect — to reflect the additional rights and safeguards that apply, including Canada's PIPEDA and Quebec's Law 25, and, for the EU/UK, the GDPR.
9. SOS and Emergency Alert Notifications
SOS and Emergency Alerts are delivered using Apple's Critical Alerts capability, which requires a special entitlement granted by Apple and a separate device-level permission granted by the recipient. An SOS includes the sender's location and an approximate street address obtained by reverse geocoding the sender's coordinates. We do not access the content of any Nest member's device beyond what is necessary to deliver these alerts and the information described in Section 1. Our Terms & Conditions require users to agree not to use SOS or Emergency Alerts for non-urgent or routine communication.
10. Cookies and Tracking Technologies
Our website (fledgenow.com) is a simple static informational page — it hosts these Terms, this Privacy Policy, and may include an FAQ and a link to the app on the App Store. It does not use cookies or other tracking technologies, and it does not collect any personal information. If this changes in the future, we will update this Policy accordingly.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes via the app or email prior to the changes taking effect.
